Recruiter Clients Marketing Corp. ("Company," "Collab VIP," "we," "us," or "our") operates the Collab VIP mobile application, website, and related services (collectively, the "Service").

Collab VIP is an application-only social platform designed for notable individuals, including entertainers, athletes, artists, creators, public figures, industry professionals, and other approved members. Approved members may be matched with other members to participate in public conversations and may have access to private messaging and other features.

This Privacy Policy explains how we collect, use, disclose, retain, and protect information in connection with the Service.

By accessing or using the Service, you acknowledge the practices described in this Privacy Policy.

1. Information We Collect

1.1 Application and Membership Information

Because Collab VIP is an application-only platform, we may collect information from prospective members for the purpose of reviewing, verifying, approving, or rejecting membership applications.

This information may include:

• Full name;
• Professional, public, or stage name;
• Email address;
• Phone number;
• Social media accounts and handles;
• Profession, occupation, industry, or field;
• Professional affiliations;
• Public profile information;
• Information you submit regarding your identity, career, audience, accomplishments, public presence, or eligibility;
• Links, documents, or other information submitted as part of an application; and
• Communications between you and Collab VIP regarding your application or membership.

We may also review publicly available information that you direct us to, such as public social media profiles, professional websites, press coverage, or other public-facing materials, for purposes including evaluating applications, verifying information, preventing impersonation, and maintaining the integrity of the Collab VIP community.

Submission of an application does not guarantee acceptance.

1.2 Account Information

If you are accepted as a member and create an account, we may collect information such as your name, email address, username, login credentials, and account identifiers.

If you use a third-party authentication service, such as Sign in with Apple, we may receive information made available through that service in accordance with your settings and the provider's policies.

1.3 Profile Information

We may collect information you provide for your Collab VIP profile, including:

• Name or stage name;
• Profile photograph;
• Biography;
• Profession or category;
• Social media information;
• Professional information; and
• Other information you choose to include in your profile.

Certain profile information may be visible to other members or, depending on the feature and context, the public.

1.4 Public Collab Conversations

Collab VIP allows approved members to participate in matched conversations ("Collab Conversations").

Collab Conversations are public content and should never be treated as confidential or private communications.

When you participate in a Collab Conversation, we collect and process the content you submit, together with information identifying or relating to the participants.

Collab Conversations may be displayed to other members of Collab VIP.

Collab VIP may also select, reproduce, edit, excerpt, format, display, publish, promote, advertise, distribute, or otherwise use Collab Conversations or portions of them outside the Service, subject to our Terms of Service.

This may occur through channels including:

• Instagram;
• TikTok;
• YouTube;
• X;
• Facebook;
• LinkedIn;
• Other social media platforms;
• Websites;
• Collab VIP applications;
• Email and newsletters;
• Digital advertising;
• Paid advertising;
• Public relations;
• Press materials;
• Promotional campaigns;
• Marketing materials; and
• Other media, platforms, technologies, formats, or distribution channels.

Such publication may include information associated with the conversation, including your name, stage name, username, profile photograph, likeness, professional information, statements, messages, and other content associated with the conversation.

You should assume that anything you communicate during a Collab Conversation could become publicly available outside Collab VIP.

Do not disclose confidential, proprietary, privileged, personally sensitive, or legally restricted information during a Collab Conversation.

Additional rights governing Collab Conversations and User Content are contained in our Terms of Service.

1.5 Private Messages

Collab VIP may allow members to communicate directly through non-public messaging features ("Private Messages").

We collect and process Private Messages as necessary to provide and operate the messaging functionality, maintain the Service, protect users, investigate abuse or violations, comply with law, and for other purposes described in this Privacy Policy.

Private Messages are intended to be non-public communications between their participants.

Collab VIP does not treat Private Messages as public Collab Conversations, and the permission allowing Collab VIP to publicly promote or distribute Collab Conversations does not, solely by virtue of this Privacy Policy, apply to Private Messages.

However, no electronic messaging system can guarantee absolute confidentiality.

Recipients of Private Messages may independently screenshot, photograph, record, copy, forward, reproduce, disclose, publish, or otherwise distribute messages they receive. Collab VIP cannot control the conduct of recipients or prevent every unauthorized disclosure.

Members should therefore carefully consider the sensitivity of information they communicate through Private Messages.

1.6 Other User Content

We may collect other information, images, reports, submissions, profile materials, or content you create, upload, send, or otherwise make available through the Service.

1.7 Communications With Collab VIP

If you contact us, apply for membership, request support, submit feedback, report another user, appeal a decision, or otherwise communicate with us, we may collect and retain those communications and associated information.

1.8 Device, Technical, Security, and Usage Information

When you use the Service, we may automatically collect technical, security, diagnostic, and usage information necessary to operate, secure, troubleshoot, understand, and improve the Service.

Depending on the technologies used to provide Collab VIP, this may include:

• Device type;
• Operating system;
• App version;
• IP address;
• Login and access times;
• Account and authentication events;
• App interactions and feature usage;
• Crash and diagnostic information;
• Security and fraud-prevention information; and
• Push notification tokens.

The particular information collected depends on your use of the Service and the technologies used to provide it.

1.9 Information From Third Parties

We may receive information from third-party services that assist us in providing the Service, including authentication, infrastructure, hosting, database, analytics, security, fraud-prevention, crash-reporting, notification, moderation, and other technology providers.

We may also receive information when you intentionally connect, submit, or direct us to information maintained by a third party.

2. How We Use Information

We may use information to:

• Review membership applications;
• Verify identity, eligibility, or application information;
• Prevent impersonation and fraudulent accounts;
• Create and administer accounts;
• Operate the Service;
• Facilitate Collab Conversations;
• Facilitate Private Messages;
• Match members;
• Display public User Content;
• Publish and promote public Collab Conversations;
• Create promotional or marketing materials using public Collab Conversations as permitted under our Terms;
• Communicate with applicants and members;
• Send account, security, match, conversation, and Service notifications;
• Provide support;
• Moderate content;
• Investigate complaints and reports;
• Detect, prevent, investigate, or respond to fraud, abuse, harassment, security incidents, unauthorized access, impersonation, or violations of our Terms;
• Maintain the integrity and security of the Service;
• Analyze and improve the Service;
• Troubleshoot technical problems;
• Enforce our agreements and policies;
• Establish, exercise, or defend legal claims;
• Comply with applicable laws, regulations, court orders, legal processes, or governmental requests; and
• Carry out other purposes disclosed when information is collected.

3. Public Distribution and Promotional Use of Collab Conversations

Public distribution is an inherent part of the Collab VIP experience.

By participating in a Collab Conversation, you should understand that the conversation may be viewed within Collab VIP and may subsequently be selected for publication or promotion outside Collab VIP.

Collab VIP may create or publish screenshots, excerpts, clips, recordings where applicable, graphics, advertisements, compilations, promotional posts, social media posts, editorial materials, and other content incorporating Collab Conversations.

Such materials may identify participating members and may contain their names, stage names, profile photographs, likenesses, professional information, usernames, statements, and other information associated with the conversation.

Once content becomes publicly available, other individuals, publications, websites, search engines, social networks, archival services, media organizations, or other third parties may independently copy, screenshot, quote, discuss, archive, index, modify, repost, or redistribute it.

We cannot control independently created copies or subsequent uses by third parties.

Our Terms of Service govern the licenses and permissions members provide to Collab VIP concerning public User Content.

4. Private Communications

Private Messages are treated differently from public Collab Conversations.

Collab VIP does not intentionally publish Private Messages as part of the ordinary public Collab Conversation or promotional functionality.

Private Messages may nevertheless be accessed, processed, preserved, or disclosed when reasonably necessary to:

• Deliver and operate messaging functionality;
• Maintain or secure the Service;
• Investigate reports, threats, fraud, abuse, harassment, impersonation, or violations of our policies;
• Respond to support requests;
• Prevent harm;
• Enforce our agreements;
• Comply with applicable law or valid legal process;
• Establish, exercise, or defend legal claims; or
• Address security incidents.

Where technically and legally appropriate, access may be performed by authorized personnel, automated systems, or service providers assisting us with these functions.

5. Security and Risk of Unauthorized Access

We use commercially reasonable administrative, technical, and organizational safeguards designed to protect personal information and communications.

However, no application, network, database, device, account, cloud service, transmission method, or electronic storage system can be guaranteed to be completely secure.

Information or communications transmitted through or stored by Collab VIP could potentially be accessed, acquired, intercepted, disclosed, altered, destroyed, copied, or distributed without authorization.

Security incidents can arise from circumstances including:

• Cyberattacks;
• Hacking;
• Malware;
• Phishing;
• Credential theft;
• Password compromise;
• Compromised member devices;
• Compromised accounts;
• Software vulnerabilities;
• Zero-day vulnerabilities;
• Configuration errors;
• Human error;
• Malicious insiders;
• Unauthorized actions by third parties;
• Telecommunications failures;
• Infrastructure failures;
• Service-provider incidents;
• Cloud-provider incidents; or
• Other circumstances beyond our reasonable control.

Members acknowledge that transmitting information electronically involves inherent security risks.

We encourage members to consider these risks before transmitting information whose unauthorized disclosure could result in personal, professional, financial, commercial, reputational, or other harm.

6. Sensitive and Confidential Information

Collab VIP may be used by individuals whose communications, identity, activities, business relationships, or personal information may have significant commercial or reputational value.

Members are responsible for determining what information they choose to communicate through the Service.

Members should exercise particular caution before transmitting:

• Trade secrets;
• Confidential business information;
• Non-public financial information;
• Unreleased commercial information;
• Passwords;
• Authentication codes;
• Financial credentials;
• Government identification numbers;
• Highly sensitive personal information;
• Legally privileged communications;
• Information subject to confidentiality agreements;
• Information belonging to another person; or
• Information whose disclosure could cause substantial personal, professional, financial, commercial, or reputational harm.

Collab VIP should not be used as a secure repository for information requiring guaranteed confidentiality or security.

7. Member Conduct and Unauthorized Disclosure

Members control information they receive through their own accounts and devices.

Another member may violate our policies or your expectations by capturing, copying, forwarding, recording, publishing, or otherwise disclosing information received through Collab VIP.

Although we may investigate violations and take action against accounts that violate our Terms or policies, we cannot guarantee that another member will comply with our rules or prevent information from being independently captured or disclosed.

You should consider this risk before sharing sensitive information with another member.

8. How We Disclose Information

8.1 Other Members and the Public

Profile information and public User Content may be displayed to other members or the public depending on the applicable feature.

Public Collab Conversations may be distributed outside Collab VIP as described in this Privacy Policy and our Terms of Service.

8.2 Service Providers

We may disclose information to vendors, contractors, processors, and other providers that help us operate Collab VIP, including providers of:

• Cloud infrastructure;
• Hosting;
• Databases;
• Authentication;
• Analytics;
• Security;
• Fraud prevention;
• Crash reporting;
• Push notifications;
• Content moderation;
• Communications; and
• Customer support.

We seek to use providers that maintain appropriate protections and require providers handling personal information on our behalf to process information consistently with applicable contractual and legal obligations.

8.3 Legal, Safety, and Enforcement Purposes

We may disclose information when we reasonably believe disclosure is necessary to:

• Comply with applicable law;
• Respond to valid legal process;
• Respond to a subpoena, court order, warrant, or governmental request;
• Protect the safety of a person;
• Investigate suspected criminal or unlawful conduct;
• Investigate fraud, threats, abuse, harassment, impersonation, or security incidents;
• Enforce our agreements;
• Protect the integrity of the Service; or
• Protect the rights, property, or safety of Collab VIP, our members, or others.

8.4 Business Transactions

If Collab VIP or Recruiter Clients Marketing Corp. is involved in a merger, acquisition, financing, reorganization, bankruptcy, asset sale, or similar transaction, information may be disclosed or transferred as part of that transaction subject to applicable law.

8.5 Aggregated or De-identified Information

We may use or disclose aggregated or de-identified information that cannot reasonably be linked to an identifiable individual for analytics, research, product development, business, or other lawful purposes.

9. Security Incidents

If we become aware of a security incident involving personal information, we may investigate the incident, take reasonable measures to contain or remediate it, cooperate with appropriate service providers or authorities, and provide notifications to affected individuals or governmental authorities when required by applicable law.

The existence of a security incident does not necessarily mean that information was accessed or misused.

Nothing in this Privacy Policy eliminates rights or obligations that cannot legally be waived or limited.

10. Account Security

Members are responsible for taking reasonable measures to secure their accounts and devices.

You should:

• Protect your login credentials;
• Use appropriate device security;
• Avoid sharing authentication credentials;
• Protect access to devices on which Collab VIP is installed; and
• Notify us promptly if you believe your account has been compromised.

To the extent permitted by applicable law, members are responsible for activity conducted through their accounts resulting from their failure to reasonably secure their credentials or devices.

11. Membership Verification

Collab VIP may take reasonable measures to determine whether applicants meet our membership criteria and whether accounts represent the individuals they claim to represent.

We may request additional information or documentation where reasonably necessary to evaluate an application, investigate suspected impersonation, prevent fraud, or maintain community integrity.

Approval by Collab VIP does not constitute a certification, endorsement, guarantee, or warranty concerning another member's identity, reputation, accomplishments, credentials, background, conduct, or statements.

Members should exercise their own judgment when interacting with other members.

12. Content Moderation

We may review, moderate, restrict, preserve, remove, or investigate User Content when reasonably necessary to operate or secure the Service, enforce policies, respond to reports, protect members, or comply with law.

Moderation may involve authorized personnel, automated systems, service providers, or a combination thereof.

We may retain information concerning reports, investigations, violations, suspensions, or terminated accounts when reasonably necessary for security, fraud prevention, abuse prevention, dispute resolution, legal compliance, or enforcement.

13. Data Retention

We retain personal information for as long as reasonably necessary to fulfill the purposes described in this Privacy Policy, operate the Service, maintain security, comply with legal obligations, resolve disputes, and enforce our agreements.

Application information may be retained following approval or rejection where reasonably necessary to maintain application records, detect fraud, prevent abusive or repeated applications, evaluate subsequent applications, maintain community integrity, or comply with legal obligations.

Account information is generally retained while an account remains active.

Private Messages may be retained while accounts remain active and for a reasonable period thereafter as necessary to operate the Service, maintain security, investigate abuse, comply with legal obligations, resolve disputes, enforce our agreements, or protect users.

Retention periods may vary based on the nature of the information, technical systems involved, legal obligations, security requirements, backup systems, and legitimate business needs.

14. Account and Data Deletion

Members may request deletion of their Collab VIP account through functionality provided in the App or by contacting us.

When an account is deleted, we will delete, de-identify, or otherwise process associated personal information as required by applicable law and applicable platform requirements, subject to information we are legally permitted or required to retain.

Some information may remain temporarily in backups, security systems, fraud-prevention records, legal records, or other systems where immediate deletion is technically impracticable or retention is legally permitted.

Public Collab Conversations previously published or distributed outside Collab VIP may continue to exist through third-party platforms, publications, search engines, archives, screenshots, reposts, or other copies outside our control.

Private Messages independently captured, copied, forwarded, recorded, or otherwise retained by another member or third party may also remain outside systems controlled by Collab VIP.

15. Your Privacy Rights

Depending on your jurisdiction, you may have rights regarding your personal information, including rights to:

• Access personal information;
• Correct inaccurate personal information;
• Request deletion;
• Obtain information regarding processing or disclosure;
• Object to or restrict certain processing where applicable;
• Withdraw consent where processing relies on consent; and
• Exercise other rights provided by applicable law.

We may verify your identity before fulfilling certain requests.

16. California Privacy Rights

California residents may have rights under the California Consumer Privacy Act, as amended by the California Privacy Rights Act ("CCPA"), where applicable.

Depending on applicability, these rights may include:

• The right to know what categories and specific pieces of personal information have been collected;
• The right to know sources and purposes of collection or use;
• The right to know categories of third parties to whom personal information is disclosed;
• The right to request deletion, subject to exceptions;
• The right to correct inaccurate personal information;
• The right to opt out of the sale or sharing of personal information where applicable;
• The right to limit certain uses or disclosures of sensitive personal information where applicable; and
• The right not to receive discriminatory treatment for exercising applicable privacy rights.

Collab VIP does not intend to sell personal information for monetary consideration.

If our practices concerning sale, sharing, targeted advertising, or sensitive personal information change in a manner requiring additional rights or notices, we will provide those rights or notices as required by applicable law.

17. Push Notifications

If you enable push notifications, we may use notification services to send information concerning matches, conversations, Private Messages, account activity, security, Service updates, and other relevant activity.

You may disable push notifications through your device settings.

18. Marketing Communications

If we send promotional electronic communications, you may opt out through any unsubscribe mechanism provided where required by applicable law.

You may continue receiving non-promotional communications relating to your account, security, membership, transactions, policies, or operation of the Service.

19. International Users

Collab VIP is operated from the United States.

If you access the Service from another country, information may be transferred to, stored in, or processed in the United States or other jurisdictions where we or our service providers operate.

Privacy and data-protection laws in those jurisdictions may differ from those in your country.

Where required by applicable law, we will provide applicable rights and safeguards concerning processing and international transfers of personal information.

20. Age Requirements

Collab VIP is not intended for children.

You may not use or apply to Collab VIP if you are under the minimum age established in our Terms of Service or applicable law.

We do not knowingly collect personal information from children in violation of applicable law.

If we learn that we have collected personal information from someone who is not legally eligible to use the Service, we may delete the information and terminate or reject the associated account or application.

21. Third-Party Services and Infrastructure

Collab VIP depends on third-party technologies, infrastructure, platforms, and service providers.

Third-party systems may experience outages, security vulnerabilities, cyberattacks, data loss, unauthorized access, or other incidents.

We evaluate and use third-party providers as appropriate for operating the Service, but we cannot guarantee that any third-party technology will operate without interruption, vulnerability, error, or security incident.

Third-party services that independently control personal information operate under their own terms and privacy policies.

22. Changes to This Privacy Policy

We may update this Privacy Policy to reflect changes in the Service, our practices, technologies, legal requirements, or other circumstances.

When we make changes, we will update the effective date.

If a change materially affects how we collect, use, or disclose personal information, we will provide additional notice or obtain consent when required by applicable law.

24. Screenshots, Recordings, and Actions of Other Members

Collab VIP cannot control the actions of other members or third parties.

A member or third party may photograph, screenshot, screen-record, copy, forward, reproduce, download, transcribe, store, disclose, publish, or otherwise capture information displayed on a device or received through the Service, including Private Messages.

Although certain conduct may violate our Terms of Service or applicable law, Collab VIP cannot guarantee that another person will comply with our rules or refrain from capturing or disclosing information.

Members should consider this risk before transmitting sensitive, confidential, commercially valuable, or reputationally sensitive information through the Service.

25. Compromised Devices and Third-Party Accounts

Unauthorized disclosure may occur without Collab VIP's systems being compromised.

Information may become accessible because of circumstances involving a member's device, email account, Apple account, cloud backup, authentication credentials, password manager, telephone number, mobile carrier, computer, browser, connected account, or other system outside Collab VIP's control.

Members are responsible for maintaining reasonable security over their devices, credentials, accounts, and systems.

Collab VIP cannot guarantee the security of devices, accounts, networks, or services that it does not operate or control.

26. Notification Privacy

Depending on a member's device and notification settings, notifications relating to Collab VIP activity or Private Messages may appear on a device's lock screen, notification center, connected computer, smartwatch, vehicle display, or other connected device.

Members are responsible for configuring their device and notification privacy settings appropriately.

27. Accidental Disclosure and User Error

Members are responsible for reviewing the recipients, audience, and context of information they submit through Collab VIP.

Information may be disclosed because a member sends content to the wrong recipient, posts information through a public feature instead of a private feature, shares a device, fails to secure an account, or otherwise makes an error.

Collab VIP cannot guarantee recovery, deletion, or prevention of further distribution after information has been disclosed to another person.

28. Account Takeovers and Impersonation

Although Collab VIP may take measures intended to verify applicants and protect accounts, we cannot guarantee that the person operating an account at any particular moment is the person identified on the account.

Accounts may potentially be compromised through phishing, credential theft, device theft, malware, social engineering, password reuse, unauthorized account access, or other means.

Members should not rely solely on the existence of a Collab VIP account as absolute verification of the identity of the individual currently operating that account.

Members must promptly notify us if they suspect unauthorized access, impersonation, or account compromise.

29. Employees, Contractors, Vendors, and Authorized Personnel

Certain Collab VIP personnel, contractors, service providers, or other authorized persons may have access to information where reasonably necessary to operate, maintain, secure, moderate, troubleshoot, support, investigate, or improve the Service or comply with legal obligations.

We seek to limit such access according to legitimate operational needs and applicable safeguards.

Despite safeguards, no organization can guarantee that an employee, contractor, service provider, malicious insider, or other person will never act improperly, exceed authorized access, circumvent controls, or unlawfully disclose information.

We may investigate suspected unauthorized access or disclosure and take appropriate action.

30. Third-Party Infrastructure and Service Providers

Collab VIP relies on third-party technologies and service providers that may include cloud infrastructure, databases, authentication systems, hosting providers, notification services, analytics services, security services, software libraries, APIs, and other technologies.

A security incident, vulnerability, configuration error, outage, unauthorized access event, data loss event, or other failure involving a third-party service may affect information processed through Collab VIP.

We seek to use service providers appropriate for the functions they perform and may take reasonable measures to evaluate and manage third-party security risks.

However, Collab VIP does not control every aspect of independently operated third-party infrastructure and cannot guarantee that third-party systems will never experience vulnerabilities, failures, or security incidents.

31. Software Errors and Unintended Disclosure

Software and technology may contain defects, vulnerabilities, configuration errors, or unexpected behavior.

Although we take commercially reasonable measures designed to operate and secure the Service, we cannot guarantee that the Service will be completely free from bugs, vulnerabilities, errors, interruptions, or unintended behavior.

Such events could potentially result in delayed delivery, incorrect display, loss, corruption, or unauthorized disclosure of information.

If we discover a material security issue, we may take measures we determine appropriate to investigate, contain, correct, or mitigate the issue and provide legally required notifications.

32. Legal Process, Litigation, and Preservation

Information maintained by Collab VIP, including Private Messages where applicable, may be preserved, accessed, or disclosed when reasonably necessary to comply with applicable law, valid legal process, subpoenas, court orders, warrants, governmental requests, regulatory obligations, or other legally enforceable requirements.

Information may also be preserved where reasonably necessary in connection with actual or anticipated litigation, investigations, disputes, fraud prevention, abuse investigations, enforcement of our agreements, or the establishment, exercise, or defense of legal claims.

Where legally permitted and appropriate, we may challenge requests that we believe are invalid, overbroad, or otherwise improper. We do not guarantee that we will challenge any particular legal request.

33. Deleted Information, Backups, and Copies

Deleting content or an account does not necessarily cause every copy of information to disappear instantaneously.

Subject to applicable law and platform requirements, information may remain temporarily in backups, logs, security records, fraud-prevention systems, disaster-recovery systems, legal-preservation systems, or other systems until deletion or overwriting occurs through ordinary retention processes.

Information independently copied, screenshotted, recorded, downloaded, forwarded, archived, indexed, or otherwise retained by another member or third party is outside our control.

We will process account and associated data deletion in accordance with applicable legal requirements and applicable platform requirements.

34. Fabricated, Altered, or Misrepresented Content

Third parties may create, alter, manipulate, fabricate, edit, misrepresent, or falsely attribute screenshots, messages, conversations, images, recordings, or other materials purportedly originating from Collab VIP.

Collab VIP cannot prevent third parties from creating or distributing fabricated or manipulated materials.

The existence of a screenshot, image, recording, quotation, or other material purporting to depict Collab VIP content does not constitute confirmation by Collab VIP that the material is authentic, complete, accurate, unaltered, or presented in context.

35. Extortion, Blackmail, Threats, and Misuse

Members may not use information obtained through Collab VIP to engage in extortion, blackmail, coercion, threats, harassment, fraud, unlawful disclosure, or other prohibited conduct.

Suspected violations may result in investigation, restriction, suspension, termination, preservation of relevant information, or disclosure to appropriate authorities where permitted or required by law.

Additional restrictions and member obligations are contained in our Terms of Service.

36. Automated Systems and Future Technologies

Collab VIP may use automated systems to operate, secure, moderate, analyze, troubleshoot, or improve the Service where permitted by applicable law.
